MIT got this all wrong. It is because they are written by asshole lawyers (I know that is redundant) who thrive on screwing people over and know it is easier to do that when the laws are incomprehensible so no one knows what they mean but the lawyers can always weasel anyone into being either wrong or right depending on their own whims. This serves as job security for themselves and their friends and a handy way to destroy anyone they decide they don't like.
