The Mayor and City Council appear to have violated, yet again, the Texas Open Meetings Act. This publication has two criminal complaints outstanding regarding TOMA violations by the Mayor and City Council. The complaints were filed with the Potter County Attorney's office at the encouragement of the Texas Attorney General's Office. The complaints were filed in October of last year. Potter County Attorney Scott Brumley refuses to address the progress of the investigation, despite repeated attempts to get an update on the investigations.
In addition, a lawsuit is currently in process brought by two citizens for additional violations.
At Tuesday's City Council meeting, the Mayor and City Council appear to have violated the Texas Open Meetings Act, yet again.
The City Council meeting was scheduled for 3:00 pm. The meeting lasted just over two hours. The last agenda item was a vote on the Amarillo Economic Development Corporation incentives for the Texas Tech University to build a veterinary school in Amarillo. This means the vote took place at approximately 5:00pm.
Also on Tuesday, at 3:29 pm, according the post's time stamp, and DURING the City Council meeting, someone posted a statement and video on the Mayor's official Facebook page with the Mayor stating the decision had already been made. This was approximately 90 minutes before any vote and prior to any input from the public! Obviously, input from the public is not considered by this Mayor and Council prior to votes. Votes are decided in advance.
