A bill introduced in the Ohio House would create a process to sue police officers for violations of rights in state court without the possibility of “qualified immunity” as a defense. Rep. Thomas West (D-Canton) introduced House Bill 332 (HB332) on June 1. The legislation would create a cause of action in state courts to sue police officers “who, under color of law, and by the officer’s act or omission in the course of the performance of the officer’s official responsibilities, subjects or causes to be subjected any other individual to the deprivation of that individual’s individual rights,” without the possibility of qualified immunity as a defense.
