If people are wondering why I occasionally let my dislike for Edger Rice Burroughs' estate slip out of nowhere when talking about classical science fiction or fantasy pulp fiction, they're part of the reason public domain characters are a RISK to use and rework for everyone: There are plenty of characters and settings from the 20s, 30s and 40s, that are out of copyright. Only a few outfits are doing anything with them. Out of FEAR of a frivolous lawsuit like what happened with Dynamite Comics and the ERB estate. So, indie outfits like American Mythology feel they HAVE to kiss some ring and sign a paper in order to use characters from the turn of the last century 'just to be safe'.
